Who Claims?

Recently, an issue came up where someone who lost a parcel through Poslaju was asked by his Seller to make a claim from Poslaju. Actually, the Seller has shrugged his responsibility of making the claim of a lost package due to the round around he is bound to face.

If the item that was sent never reached its destination, the onus is on the Seller to file a claim and see it through until either a new item is replaced for the Buyer or a refund is made, even if it is just partial refund.

On the other hand, if the item was damaged on transit, then the onus is on the Buyer to make a claim with the postal department or courier company.

The line is drawn clearly on whose responsibility it is, taking into account that the Seller has packed the item securely and yet still damaged due to mishandling. If you are unfortunately in such a situation, know clearly who should take what action for a swift claim from the delivering company.
