September 9, 2007 – 3:14 pmI read in a forum that an interested party was very mad when the Seller refused to sell an item to him as listed on his For Sale page. What this Buyer failed to recognise is that if an item is listed “For Sale”, it means that he is extending an invitation to trade. Of course, the Buyer and Seller could then negotiate but both have the right to change their mind and pull out of negotiates.
I find that the potential Buyer has misunderstood the meaning of listed For Sale. Whereas to list an item in an auction, we are legally bound to sell the item as is and at the closing price because a bids are contractual, as opposed to an item that is listed “For Sale”.
So my point is that the potential buyer has no basis to get pissed at the Seller since he is dealing within the law of Malaysia. It was not as if money or goods has exchanged hands.
