eBay Ordered To Pay £31m In Damages

eBay has been ordered by the French commercial court to pay LVMH Moët Hennessy Louis Vuitton in damages for selling counterfeit goods on its auction marketplace. LVMH Moët Hennessy Louis Vuitton owns some of the biggest names fashion apparel, accessories and perfumes from Fendi to Emilio Pucci to Marc Jacobs.

eBay is going to contest it, of course.

The problem is not that eBay has allowed Sellers to sell fake goods on their platform but did not go enough to stop these people from trading in counterfeit branded goods. Even if these items are REAL, LVMH or other license holders would still have a case as these sellers who trade online are not authorised sellers. So this really is a no win situation for eBay, Sellers, Buyers or the brand name holders.

People have questioned if this will be the end of online trading. I don’t think so. There are still plenty of things to buy and sell, not necessarily branded, not necessarily new. People can still trade whatever they can get from home and there would still be people who want to buy them. Of course, a used branded item would still be able to find a new owner on eBay.

The way I see it, online marketplaces will still continue to thrive, except that the turnover will not be so great now that these overpriced items, counterfeit or otherwise, are taken off the virtual market.
